Cancellation of Removal for Permanent Residents in Removal Proceedings

To be eligible for cancellation of removal for permanent residents, an individual must meet the following requirements:

1.They must have been a lawful permanent resident for at least five years;
2. They must have resided in the United States continuously for at least seven years after being lawfully admitted;
3. They must not have been convicted of an aggravated felony.

If an LPR meets these eligibility requirements and is granted cancellation of removal, they will be allowed to remain in the United States and maintain their status as a permanent resident.
