Adjustment of status is the process of changing an individual's immigration status from a non-immigrant (temporary) to an immigrant (permanent) status while they are physically present in the United States.
Adjustment of status is typically available to individuals who entered the United States legally or qualify under INA section 245(i) with an I – 130 petition filed before April 30, 2001. Such individuals are eligible to apply for a green card (permanent residence) without having to leave the United States.
